Carlos Montalvo and Carlos Lopez became the first jockeys to be penalized for violating the new state-implemented riding crop regulations at Monmouth Park as they both received a five-day suspension and a $500 fine July 23 for actions during the July 11 card at the New Jersey track.

While Lopez waived his right for a hearing and will accept the fine and suspension, Montalvo's agent, Doug Hatten, said his rider plans to appeal the stewards' decision.

Lopez will be suspended from July 24-28, while the ban for Montalvo is scheduled for Aug. 24-28.

As of July 22, Montalvo is currently seventh in the leading rider standings at Monmouth Park.

Both riders were found to be in violation of New Jersey's controversial ban on the use of a riding crop except for safety reasons. The sanctions against the riders did not change the order of finish or purse distribution in either race.

According to the Equibase chart, in the July 11 first race it was noted that Montalvo used his crop three times in guiding 28-1 shot M I Six to victory. In published reports it was indicated that Montalvo used the crop for safety because M I Six was coming out.

Lopez was aboard Venezuelan Talent  in the July 11 seventh race, who finished second. There was no mention of Lopez using his crop in the Equibase chart.

Monmouth stewards have yet to decide if they will fine or suspend California-based jockey Flavien Prat for his ride aboard Hot Rod Charlie  in the TVG.com Haskell Stakes (G1). Hot Rod Charlie was disqualified from first and placed last in the Haskell for coming in and clipping heels with Midnight Bourbon , who unseated rider Paco Lopez.

The stewards are expected to conduct a hearing on Prat's ride next week.
