Suspension, Fine Upheld for New York Trainer

State regulators have upheld a 15-day suspension against owner/trainer Luis Gutierrez for racing a horse with an impermissible level of Flunixin at Finger Lakes Race Track.
The state Gaming Commission on May 27 also deferred on deciding a case involving trainer Anthony Dutrow and owner/trainer/breeder Peter Kazamias.
In the matter of Gutierrez, the board upheld a hearing officer's recommendation that the owner/trainer be suspended for 15 days and pay a $1,000 fine for the elevated level of the drug in a horse running in the eighth race Oct. 14, 2013.
In the case involving Dutrow and Kazamias, officials said the case—consolidated into one case involving the two men because they share a lawyer and overlapping testimony—needed more time before a decision in the matter can be reached.
The case involves a possible TCO2 overage in the horse Mambo Fever in a 2009 race at Aqueduct Racetrack. According to The Jockey Club Information Systems, in her only start at Aqueduct that year the daughter of Stormin Fever finished second in the Tempted Stakes (gr. III) on Nov. 7.
